Terms of Service

The agreement

These terms are between your business ("you") and CareSiteBuilder LLC ("we"), the operator of HubsteriaBrew. By creating an account, accepting an invitation, or using the app, you agree to them. If you are accepting on behalf of a business, you confirm you are allowed to do so.

Your account and your people

• Accounts are created by invitation or sign-up by the business owner. Sign-in details are personal and must not be shared.
• You decide which of your staff get which role, and you are responsible for keeping those roles current.
• You must remove access promptly when someone leaves your business.
• You are responsible for what happens under your accounts.

Acceptable use

• Use the app only for lawful café and retail operations.
• Do not attempt to reach another business's data, bypass role limits, or probe the service for weaknesses without written permission.
• Do not resell or white-label the service without a written agreement.
• Do not upload content you have no right to use, including product photographs.

Money and your records

HubsteriaBrew records the money you tell it about. Posted sales, payments, refunds and cash movements cannot be edited or deleted — mistakes are corrected with a reversal that stays visible. This is deliberate and protects you.

You remain responsible for your own tax filing, receipts required by law in your country, and for reconciling your drawer and bank. We provide the records; we do not act as your accountant.

Payments to us, trials and cancellation

• Paid plans are billed for the period shown at sign-up. A free trial, where offered, runs for the stated number of days and then requires a plan to continue selling.
• Fees are payable in advance and are not refundable for a period already started, except where the law requires otherwise.
• You may cancel at any time; access ends at the close of the paid period.
• We may suspend an account for non-payment or for a serious breach of these terms, after notifying the account owner.

Card payments

Card and wallet payments are processed by the payment provider you connect, under that provider's own agreement with you. We pass the transaction to them and record the result; we never hold your customers' card numbers and we are not a party to that payment contract.

Service availability

We work to keep HubsteriaBrew available and fast, but we do not promise uninterrupted service. Planned maintenance is announced to account owners where practical. The app keeps working for counter sales during brief interruptions wherever technically possible.

Your data

Your café's data stays yours. We use it only to provide and support the service, as described in the Privacy Policy. You can request an export of your records at any time while your account is active.

Limits of responsibility

The service is provided as it is. To the extent the law allows, we are not responsible for lost profit, lost sales, or indirect losses, and our total responsibility to you is limited to the fees you paid us in the twelve months before the claim.

Nothing in these terms limits responsibility that cannot be limited by law.

Ending the agreement

Either side may end this agreement with notice. On ending, your access stops and we retain the financial records we are required to keep, as set out in the Privacy Policy.

Governing law and disputes

These terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules.

The operator is CareSiteBuilder LLC, 116 Francesca Ct, Palm Desert, CA 92211, USA. Any dispute that cannot be resolved informally within 30 days will be brought in the state or federal courts located in Maricopa County, Arizona, and each party consents to that venue.
